After several months of investigation regarding how harmful it is and its lasting effects, Juul vaping products are officially a thing of the past. At least as far as the Food and Drug Administration is concerned. Earlier today, the FDA formally decided to enforce a nationwide ban on selling and marketing all Juul vaping products.
USA Today reports that the U.S. Food and Drug Administration’s decision to issue a ban on Juul is due to “insufficient and conflicting” data on the “genotoxicity and potentially harmful chemicals” from the company’s e-liquid pods in the company’s application to continue selling non-fruit-flavored products. The terms of the ban state that Juul must halt sales of its vaping device and the four types of e-liquid pods: Virginia tobacco flavored pods with nicotine levels of 5% and 3% and menthol-flavored pods at nicotine concentrations of 5.0% and 3.0%.
Additionally, the FDA revealed that Juul’s application to continue selling its vaping products lacked sufficient evidence necessary to prove that the “toxicological profile” of its products would be “appropriate for the protection of public health. As for how the decision impacts U.S. retailers that sell Juul products, the FDA said companies should contact Juul directly with any questions about products they currently have on shelves or in their inventory.
Juul Ban Does Not Make It Illegal
However, it should be noted that although the sale and marketing ban of Juul is strictly enforced, the ban does not restrict consumers from possessing or using the devices, as the FDA does not enforce consumer possession or use of vaping or other tobacco products.
Throughout the last few years, the FDA reviewed marketing applications for Juul and other vaping companies following demand from anti-tobacco groups to crack down on products that target youth, leading to the rise in youth vaping habits.
