<p>As the first day of <strong>NBA YoungBoy</strong>’s trial takes place, it seems the rapper has scored a win in his gun case.</p>
<p>A judge has tossed out the lyrics to ‘Gun Smoke’ and ‘Life Support’ after prosecutors submitted the lyrics as evidence, <a href="https://www.xxlmag.com/youngboy-never-broke-again-lyrics-evidence-thrown-out/">XXL</a> has confirmed.</p>

<blockquote><p><a href="https://www.xxlmag.com/roddy-ricch-kodak-black-nba-youngboy-best-rappers-under-25/" target="_blank" rel="noopener">NBA YoungBoy</a>&#8216;s trial for gun possession began on Tuesday (July 12). In a ruling in court today, Judge R. Gary Klausner of the Central District of California shut down the prosecution&#8217;s attempts to use the Baton Rouge, La. rhymer&#8217;s lyrics as evidence. <em>XXL</em> has confirmed the ruling.</p></blockquote>
<p>The lyrics in question are said to mention the gun YB had in possession when he was arrested.</p>
<p>This ruling comes just months after <strong>Young Thug</strong> and <strong>Gunna</strong> were<a href="https://dev.theshaderoom.com/breaking-young-thug-gunna-among-28-people-indicted-on-56-counts-charges-include-murder-armed-robbery-more/"> indicted</a> in a YSL RICO case where song lyrics were used to justify their arrest and deny bond for the artists.</p>

<p>According to the 56-count indictment, <a href="https://dev.theshaderoom.com/prosecutors-use-lyrics-from-multiple-young-thug-songs-as-evidence-in-his-indictment-includes-hit-single-ski-slatty-more/">lyrics</a> from Young Thug’s hit single, ‘Ski&#8217; and &#8216;Slatty&#8217; are being used as evidence. Prosecutors called the songs&#8217; text “an overt act in furtherance of the conspiracy.”</p>
<p>In May, New York passed a law limiting the use of lyrics deemed as &#8220;creative expression.&#8221;</p>
<p>According to <a href="https://www.mic.com/culture/new-york-state-bill-limits-lyrics-as-evidence">Mic</a>:</p>
<blockquote><p><a href="https://www.nysenate.gov/legislation/bills/2021/s7527" target="_blank" rel="noopener noreferrer">Senate Bill S7527</a> would not completely outlaw presenting lyrics to a jury, but it would require that evidence labeled as “creative expression” be proven to have been literal rather than figurative or fictional. To become law, the bill, which is sponsored by Senators Jamaal Bailey and Brad Hoylman, must now also pass the State Assembly in a <a href="https://nyassembly.gov/leg/?bn=A08681&;leg_video=" target="_blank" rel="noopener noreferrer">companion bill</a> sponsored by Assembly member Catalina Cruz.</p></blockquote>
<p><a href="https://dev.theshaderoom.com/nba-youngboy-faces-new-charge-in-california-that-poses-threat-to-his-freedom-exclusive-details/">As previously reported</a>, YB was stopped in LA back in 2021, and he was in possession of a .45 ACP caliber pistol as well as ammunition. “Defendant GAULDEN possessed such firearm and ammunition knowing that he had previously been convicted of a felony crime punishable by a term of imprisonment exceeding one year, namely, Aggravated Assault with a Firearm,” the charging document read.</p>
