A woman, who claimed she developed ovarian cancer by using Johnson & Johnson baby powder, won a $417 million award back in August. However, a judge tossed out the ruling on Friday.
According to the LA Times, Los Angeles County Superior Court Judge Maren Nelson granted Johnson & Johnson’s request for a new trial, citing errors and jury misconduct in the previous trial. The judge ruled that the “award for damages was excessive” and said there wasn’t enough evidence to prove the company acted with malice.
Eva Echeverria, who has since passed away, alleged that Johnson & Johnson failed to warn its consumers about potential cancer risks associated with talcum powder. According to court docs, she used the powder everyday beginning in the 1950s until 2016. She was diagnosed with ovarian cancer back in 2007.
Echeverria’s attorney says he plans to appeal the decision.
